The Code of Practice was developed by the SIAA because the Scottish advocacy movement wanted a document that explained in detail what advocacy was and what advocates do. The aim of this document is to show advocacy in action. This is a document that can be used to help train new advocates, help to refresh and re-motivate established advocates and help an organisation measure itself and check how well they are doing. It can also help advocates and advocacy organisations think through problems and dilemmas and hopefully find solutions. Also, it will help to remove the mystery that sometimes surrounds advocacy and help people who come into contact with advocacy to understand it better.

A review group, chaired by Professor Jim McManus, was appointed in January 2008 to undertake a limited review of the Mental Health (Care and Treatment) (Scotland) Act 2003 to consider efficiency and patient experience of the Act. The review group reported in March 2009. The review group’s report focused on five main areas of activity: advance statements, independent advocacy, named persons, medical matters, and tribunals as well as considering some related issues. The Scottish Government would welcome views on the report’s recommendations. There are three issues on which consultees’ views would be particularly welcome: named persons, the preparation of medical reports and the issue of multiple hearings. In each of those areas the review group clearly identified a range of options before making their recommendations.
