The review acknowledges the crucial role child care lawyers play in protecting vulnerable children, and does not propose changes to the availability of public funding for or the level of legal representation of any of the parties to proceedings. It also recognises the complexities of care cases and the range of factors which impact on care proceedings and that there is ‘no quick fix' to improve the system.

There is wide agreement about the outcomes we all want for every child – that they should be healthy, stay safe, enjoy and achieve, make a positive contribution and achieve economic wellbeing. Improved outcomes can only be achieved and sustained however, when agencies work together to design and deliver integrated services around the needs of children and young people. There is widespread support, and increasing evidence, for this approach. A considerable amount of effective practice is already in place.

Improving the way key people and bodies safeguard and promote the welfare of children is crucial to improving outcomes for children. In his report into the death of Victoria Climbié, Lord Laming concluded that “the suffering and death of Victoria was a gross failure of the system”. Section 11 of the Children Act 2004, therefore, places a duty on key persons and bodies to make arrangements to ensure that in discharging their functions, they have regard to the need to safeguard and promote the welfare of children. This guidance sets out these key arrangements for safeguarding and promoting the welfare of children. It applies to all those key local people and bodies named under section 11(1) of the Children Act 2004. Part 1 of the guidance sets out the arrangements that are likely to be common to all or most of the agencies to which the duty applies. There will, however, be differences in how they are applied depending on the functions of each agency. Part 2 deals with implementation in each particular agency to which the section 11 duty applies. The guidance is for the Chief Executives and senior managers in all the bodies named in section 11 of the Children Act 2004. On receipt of this document they are asked to take what steps are necessary in order to carry out their responsibilities under section 11 of the Children Act 2004.

The Government is determined to improve the experiences of children in care. Despite efforts to support them, there remains a significant gap between the quality of life of young people in care and those raised in supportive families. Bridging this gap requires urgent, sustained action across central and local government, from practitioners in all aspects of children and young people's lives, and from their carers, friends and family. The Care Matters: Time for Change White Paper sets out the steps the Department will take, together with local delivery partners, to improve outcomes for children and young people in care. It builds on responses to the Green Paper Care Matters: Transforming the Lives of Children and Young People in Care and the conclusions of four working groups established to investigate best practice in supporting those in care.
