This code of practice is primarily for local authority staff with duties and powers under the Adults with Incapacity (Scotland) Act 2000. It is particularly relevant to mental health officers, managers of community care teams, learning disability teams, and mental health teams. It contains detailed guidance on all the statutory functions which are conferred on local authorities under the 2000 Act. It supersedes the code published in March 2001 to take into account subsequent changes to the 2000 Act, and in particular those introduced in Parts 2 and 3 of the Adult Support and Protection (Scotland) Act 2007.

This code is for anyone who is authorised under an intervention order or guardianship order. In this code ‘you’ means the intervener or guardian. The code applies equally to a lay person and to a professional such as a solicitor or accountant. Professionals will also need to apply their own code of conduct, professional ethics and good practice, and follow professional regulatory requirements in relation to their duties as an intervener or guardian. Since 2004 several changes to the Act have been introduced. This revised code of practice takes account of the amendments made to part 6 of the Act.

This code is for use by both individuals and organisations who have been authorised by the Public Guardian under Part 3 of the Act to withdraw funds from the account of an adult and apply them for the adult’s benefit. A person authorised to do so is referred to as the ‘withdrawer’. A supplementary document is available for organisations outlining the information required to support their suitability for the purpose of acting on behalf of an adult. The code will also be of interest to agencies providing information and advice to carers, other family members and service users. This revised edition of the code of practice for those authorised to access funds, takes into account of changes to Part 3 of the Act, introduced in Part 2 of the Adult Support and Protection (Scotland) Act 2007. It has been prepared in collaboration with the Office of the Public Guardian.

Three related Scottish act, the Adult Support and Protection (Scotland) Act 2007 (ASP), the Adults with Incapacity (Scotland) Act 2000 (AWI), and The Mental Health (Care and Treatment) (Scotland) Act 2003 (MHCT) are compared. Three tables are presented providing short extracts from each of the acts for comparison purposes. The extracts have been rephrased for ease of understanding.
