This resource is intended for anyone who wants to promote informed practice in work with vulnerable, disempowered and marginalised adults by putting into practice the values of sensitivity and awareness of how they can be discriminated against. Using it with practitioners can help them critically evaluate their work and explore the extent to which their own practice and the practices of their organisations reflect a commitment to working collaboratively with service users, challenging discrimination at all levels, valuing diversity, and promoting service users' rights, including the right to take risks. The Adult Support and Protection Act 2007 was passed by the Scottish Parliament in spring 2007. This code of practice fulfils the obligation placed on Scottish Ministers by Section 48 of the Act, to prepare a code of practice containing guidance about the performance of functions by councils and their officers and health professionals under the Act. It provides information and guidance on the principles of the Act, about the measures contained within the Act, including when and where it would normally be appropriate to use such powers. This code should be used in conjunction with other relevant codes of practice as appropriate, such as the codes of practice for the Mental Health (Care and Treatment) (Scotland) Act 2003, the Adults with Incapacity (Scotland) Act 2000 and the code of practice for Social Service Workers and Employers of Social Service Workers.

Part 1 of the Adult support and protection (Scotland) Act 2007 scheduled to commence in Autumn 2008, introduces new measures for the protection of adults at risk of harm. These include rights of entry to settings where adults are thought to be at risk of harm, the introduction of a range of protection orders including assessment, removal and banning orders and the creation of local multi-agency Adult Protection Committees (APCs) across Scotland. APCs have a significant role in ensuring cooperation and communication within and between agencies to promote appropriate support and protection for adults. Comments are invited the draft guidance for APCs.
