The purpose of this guidance is to assist those responsible for conducting video-recorded interviews with vulnerable, intimidated and significant witnesses, as well as those preparing and supporting witnesses during the criminal justice process. The first edition of this substantial guidance was issued in 2002. This third edition takes account of changes to the special measures provisions as a result of the Coroners and Justice Act 2009, the ACPO (2010) “Advice on the Structure of Visually Recorded Interviews with Witnesses” and aims to improve the quality of video recorded statements. The guidance is generic and readers are reminded that each witness is unique. This document considers: preparing and planning for interviews with witnesses; decisions about whether or not to conduct an interview; and decisions about whether the interview should be video-recorded or whether it would be more appropriate for a written statement to be taken following the interview. It applies to both prosecution and defence witnesses and is intended for all persons involved in relevant investigations, including the police, adults and children’s social care workers, and members of the legal profession. The guidance specifically covers vulnerable and intimidated witnesses (eligible for Special Measures) and significant witnesses (not eligible for Special Measures).

Baroness Jean Corston published her report on a Review of Women with Particular Vulnerabilities in the Criminal Justice System on 13 March 2007. The report made 43 recommendations for improving the approaches, services and interventions for women in the criminal justice system and women at risk of offending. The Government's response sets out the commitments that have been made across departments to take forward the recommendations.

The premise behind this guide is that all victims and witnesses are entitled to receive a high quality service from the police starting, with their initial contact and the person they first meet. With the aim of helping to provide a standard of service that meets this entitlement, the guide describes good practice for police officers and police staff who are the first point of contact for vulnerable and intimidated victims and witnesses. This guidance is designed to assist the police through a number of processes that will afford these witnesses equal access to the criminal justice system and help them to give their best evidence at any subsequent trial. As the gateway to the system, it is imperative that the police identify these people in order to ensure that they have access to the special measures that they could need. The guide sets out a number of prompts intended to aid the identification of victims and witnesses who may be vulnerable or intimidated. In focusing on the initial point of contact with the criminal justice system, this document complements Achieving Best Evidence in Criminal Proceedings: Guidance on Interviewing Victims and Witnesses, and Guidance on Using Special Measures (2011) which looks at good practice from the investigation stage onwards.

Mental Capacity Act 2005 Equality Impact Assessment is part of the Mental Capacity Implementation Programme of 30 May 2007 enabled by the Mental Capacity Act 2005. The Equality Impact Assessment examines the potential impacts of the Act on the diverse groups of people affected by it, by race gender disability.
