This briefing gives an overview of the development of policy from special educational needs to additional support for learning. It briefly describes the new legal framework introduced in 2005 and considers some of the issues that have arisen from it. Legislation enacted in 2014 in England and 2016 in Scotland attempts to boost the rights of children and young people with special and additional support needs in the context of education, particularly with regard to opportunities for their participation in decision-making and local planning, with governments in both nations claiming that the new measures place the UK at the forefront internationally on this issue. There are, however, key differences in the respective nations’ legislation and policy, as well as similarities, which the article explores. Using case studies, it then examines the central issues arising in each jurisdiction in the practical realisation of the relevant rights. The article concludes with a comparative discussion of the recognition of children’s autonomy in the context of education in the two nations, highlighting gaps between rhetoric and reality. The Education (Additional Support for Learning) (Scotland) Bill seeks to make technical amendments to the Education (Additional Support for Learning) (Scotland) Act 2004. The key proposal is to allow out of area placing requests. The Bill also proposes changes to the Additional Support Needs Tribunal. This briefing summarises the legislative and non-legislative recommendations made by the Education, Lifelong Learning and Culture Committee in its stage 1 report and the Scottish Government’s response to it. It also summarises the key amendments passed at stage 2 and considers the key areas of debate where no amendments were passed.

This literature review has the following broad elements: a comparative review of definitions of children with special/additional support needs and definitions of types of placement, and a review of approaches to pedagogy and curriculum for children with special/additional support needs. The aim of the project is to review the definitions of special/additional support needs employed in different countries, the placement patterns of children with particular types of difficulties in different countries, and the curriculum and pedagogy for children with special/additional support needs in different countries. The report presents data drawn from international sources on categorisations of particular types of difficulty and disability in different countries, and case studies of five countries, examining more closely the legal and policy context underpinning the identification and placement of children with particular difficulties, the relationship of the system of special needs education to the mainstream education system, the resourcing of additional provision and the nature of specialist input. The report also focuses on the provision for children with particular types of difficulty in Scotland, and goes on to draw some final conclusions.
