Under the Disability Discrimination Act 1995 (as amended), the Government can publish statutory guidance which provides advice on matters to be taken into account by adjudicating bodies, such as courts and tribunals, when they are determining whether a person is a disabled person for the purposes of the Act. The existing guidance was written in 1996 and is now being revised and updated. The closing date for responses to this consultation document was 31 October 2005

The author provides an overview of the key components of the Americans with Disabilities Act (ADA). A discussion is offered on why and how persons with disabilities are discriminated against. The standard stereotypes often heard about persons with disabilities are offered. Critical United States Supreme Court decisions are presented; these decisions have greatly limited the power of the ADA in protecting the rights of persons with disabilities. Even though the United States Supreme Court has narrowed the impact of the ADA in American life, a number of Equal Employment Opportunity Commission (EEOC) cases are presented, suggesting this federal agency is attempting to protect persons with disabilities against discrimination. The final part of the paper deals with the topic of advocacy; advocacy may well be one of the most effective tools to help insure that the rights of people with disabilities are protected in the 21st century. The aims of the research were to provide a picture of work and daily activities of disabled people, compared with non-disabled people, and to examine general attitudes to disability. The study also sought to examine peoples experience of their disability, including discrimination and prejudice, across a range of different areas of life. The research was commissioned to inform the Governments policies to promote equality by helping disabled people overcome the barriers which may exclude them from learning, employment and other aspects of society.

The Disability Discrimination Bill will complete the Government's reforms of civil rights legislation to deliver effective rights for disabled people. Two key measures in the Bill will extend the Disability Discrimination Act (the DDA) to cover the functions of public authorities, and to impose a positive duty on public bodies to eliminate discrimination and harassment, and promote equality of opportunity for disabled people. This consultation sets out and seeks views on the Government's plans in respect of the principal regulation-making powers affecting the public sector, and will allow the Government to explain the proposed content of Regulations, to inform Parliament during its consideration of the Bill.
