Under section 17 of the Health and Social Services and Social Security Adjudication Act 1983 (HASSASSA), social services departments have a discretion to charge for most non-residential services for older or disabled adults. Government policy after 1990 has actively encouraged this. In January 1994 the SSI issued an advice note for its inspectors on issues affecting how authorities exercise their powers under section 17.
