This article explores the relationship between anti-discrimination policy and existing social policies directed towards disabled people. It proposes a conception of ‘spheres’ of social policy, in which different spheres advance different dimensions of equality. Within each sphere, definitions of disability are based on relevant comparisons which determine who should be recognised as disabled for the purposes of the policy. Examples of definitions are given using material from a cross-national European project. Examples are also given where social policies provide for disabled people without defining a disability category. The implications of these findings for anti-discrimination policy are drawn out, and problems in defining disability for the purposes of ‘fourth generation’ equality rights are identified. It is suggested that there are limitations to the extent that equality policy can be founded on non-discrimination principles, and that a more substantive equality policy for disabled people needs to learn from debates and experiences within social policy.

This book is based on a conference organised jointly by the editors to mark the European Year of Disabled People. It explores the range of legal strategies which have been adopted, both nationally and internationally, to achieve equality for disabled people and facilitate their inclusion into mainstream society. It examines current developments in anti-discrimination law, both within Member States and at EU level. It also assesses the effectiveness and potential of the human rights framework for disabled Europeans. In addition, a number of approaches to the enforcement and promotion of disability rights are considered. Contributors to this book, drawn from across Europe, represent a variety of different backgrounds. They include leading academics in the field, as well as campaigners and others working to improve or enforce disability-related legislation. Under the Disability Discrimination Act 1995 (as amended), the Government can publish statutory guidance which provides advice on matters to be taken into account by adjudicating bodies, such as courts and tribunals, when they are determining whether a person is a disabled person for the purposes of the Act. The existing guidance was written in 1996 and is now being revised and updated. The closing date for responses to this consultation document was 31 October 2005

For many Employers, disabled Employees are recognised as valuable and equally significant members of staff. Thus the disabled workforce is increasing. The Disability Discrimination Act 1995 in Northern Ireland and the Employment Equality Act, 1998 in the Republic of Ireland introduced a number of protective measures for disabled workers. This means that an Employer must not treat a disabled individual any differently than he would treat any other member of staff. The legislation requires the Employer to make reasonable adjustments (NI)/reasonable accommodation (ROI) to working conditions. This includes premises and working hours/practices and procedures.

Under Article 54A of the Disability Discrimination Act 1995, the Equality Commission for Northern Ireland may prepare and issue codes of practice giving practical guidance: (a) to employers, service providers or other persons to whom provisions of Part II or Part III of that Act apply on how to avoid acts which are unlawful under those Parts or any other matter relating to the operation of those provisions in relation to them; or (b) to any person on any other matter, with a view to: (i) promoting the equalisation of opportunities for disabled persons and persons who have had a disability, or (ii) encouraging good practice relating to the treatment of such persons, in any field of activity regulated by any provision of Part II or Part III of that Act. Part II of the Act relates to discrimination in the field of employment while Part III of the Act relates to discrimination in other areas such as goods, facilities, services and premises.

The Disability Discrimination Act 2005 ("the 2005 Act") makes substantial amendments to the Disability Discrimination Act 1995 ("the DDA") building on amendments already made to that Act by other legislation since 1999. The 2005 Act takes forward the Government's remaining proposals. The 2005 Act contains provisions giving effect to many new provisions which did not appear in the draft Bill: in particular sections 6 to 8 (rail vehicles), section 9 (disabled persons' parking badges), section 15 (general qualifications bodies) and section 16 (improvements to let dwelling houses).
