People with learning disabilities are more likely to develop mental health problems compared to the general population. The Government’s mental health strategy, ‘No health without mental health’ (DH, 2011), makes several references to people with learning disabilities. In particular, it highlights the importance of mental health services for people with learning disabilities and autism, the need to ensure that mainstream services are inclusive to this group, including that staff have appropriate skills and can provide reasonable adjustments to meet individual needs. The strategy also mentions the need for early intervention to prevent later problems for children with special educational needs and disabilities, including those who have underlying or associated mental health problems. In 2012, the Government issued an accompanying implementation framework that aims to translate the ideals of the strategy into concrete actions on a local level. This article discusses what the implementation framework means for people with learning disabilities. It shows that, despite the strategy highlighting the needs of people with learning disabilities, the framework offers little specifically for this group. This raises concern that this group will remain off the radar for those in mainstream services and organisations that could support them to maintain their mental health and wellbeing.

This article briefly summarises the main Welsh policy principles that apply to all people with learning disabilities, including those with mental health needs or severe challenging behaviour. The authors briefly review progress in supporting people with complex behavioural needs, reflect on areas where development in practice has not lived up to policy rhetoric and also examine the consequences of this policy to practice gap. The authors then describe current barriers to further service development. Finally they suggest a number of changes that are necessary for the current inadequacies to be resolved.

By the end of this year child and adolescent mental health services will be required to be fully comprehensive and include care pathways for children and young people with learning disabilities and mental health problems under the Public Service Agreement Targets. In this article the authors describe how services have traditionally served this group, explore the policy context for change and discuss some of the projects currently underway that aim to address the PSA target for later this year.
Learning disability and the Scottish Mental Health Act

Purpose: The purpose of this paper is to investigate the use of the Mental Health (Care and Treatment) (Scotland) Act 2003 for people with learning disabilities in Scotland, in the context of the recent commitment by the Scottish Government to review the place of learning disability (LD) within the Act. Design/methodology/approach: All current compulsory treatment orders (CTO) including LD as a type of mental disorder were identified and reviewed. Data was collected on duration and type of detention (hospital or community based) for all orders. For those with additional mental illness and/or personality disorder, diagnoses were recorded. For those with LD only, symptoms, severity of LD and treatment were recorded. Findings: In total, 11 per cent of CTOs included LD as a type of mental disorder. The majority of these also included mental illness. The duration of detention for people with LD only was almost double that for those without LD. A variety of mental illness diagnoses were represented, psychotic disorders being the most common (54 per cent). Treatment was broad and multidisciplinary. In all, 87 per cent of people with LD only were prescribed psychotropic medication authorised by CTO. Originality/value: There has been limited research on the use of mental health legislation for people with learning disabilities. This project aids understanding of current practice and will be of interest to readers both in Scotland and further afield. It will inform the review of LD as a type of mental disorder under Scottish mental health law, including consideration of the need for specific legislation. (Publisher abstract)
Government proposals to close the Bournewood gap

The authors explain the government's proposals to address some of the issues required to close the 'Bournewood Gap'. The safeguards are for people who lack capacity and are deprived of their liberty but do not receive mental health legislation safeguards. The principles of the Mental Capacity Act will apply, including the requirement to act in the best interests of the incapacitated person and in the least restrictive manner.

This article provides a brief historical perspective and describes recent policy guidance relating to the mental health needs of people with learning disabilities in England. It also highlights the role that health and social care services have played turning the policies into practice. Finally it will suggest why people with learning disabilities continue to be one of the most excluded and discriminated groups within our society and how our drive towards social inclusion remains the key challenge for all of us.

This article addresses three broad areas. First, it provides an overview of the current structure of health and social services within Northern Ireland and summarises how these structures are expected to change within the next few years. Second, it outlines the key policy objectives in relation to the health of people with learning disabilities, giving particular attention to individuals among this population who develop mental health problems. Third, it considers key challenges that may lie ahead if the recently stated policy objectives are to be realised.
