This guide covers human rights and discharging people from mental health hospitals and is aimed at practitioners supporting people before, during or after discharge. It aims to provide practitioners with the knowledge to use human rights in practice, to design and deliver rights-respecting services. It focuses on three key issues for hospital discharge: delayed discharge from hospital, premature discharge from hospital, and discharge into an appropriate setting. It aims to promote independence and well-being, in the least restrictive setting possible; promoting recovery; focusing on the needs and wishes of the person and promoting autonomy. The guide is part of a series of toolkits on mental health/capacity and should be read in conjunction with ‘Mental health, mental capacity and human rights: a practitioner's guide’.
