The Mental Capacity Act places a duty on local authorities and the NHS to refer people who may lack capacity to make decisions about serious medical treatment or about a change in accommodation to an Independent Mental Capacity Advocate (IMCA) service. This article describes the experiences and lessons learnt in Croydon, where one of the seven IMCA pilots has taken place.

This practice guidance covers the involvement of Independent Mental Capacity Advocates (IMCAs) in safeguarding adults. It replaces the Practice guidance criteria for the use of IMCAs in safeguarding adults published by ADASS in 2007. Coverage includes who can be represented by an IMCA, the role of the IMCA, contact with the person at risk, information sharing, the appropriate adult role, IMCA challenging decisions and when the IMCA role ends. It is primarily aimed at professionals who have responsibilities in relation to safeguarding adults and may be involved in safeguarding adults proceedings.

The Mental Capacity Act 2005 introduced the role of the independent mental capacity advocate (IMCA). This is essentially a new safeguard for adults when they lack the capacity to make critical health and welfare decisions, particularly those without family or friends to represent them. This article details the statutory role that IMCAs can have in adult protection cases, and discusses their early involvement in adult protection cases.
