This easy to read guide is designed to support people with learning disabilities and other vulnerable adults to be aware of how they should and should not be treated. It highlights the importance of how vulnerable adults, and their carers, know about their rights and are empowered to be a key part of plans to stop bullying and abuse. It first describes details on The Safeguarding Vulnerable Groups Act 2005, and the laws it contains, before outlining what safeguarding is, and how to spot various forms of bullying and abuse including financial abuse, emotional abuse, medical abuse, ‘friend’ crime and discrimination. The guide also presents information on what employers must do to ensure their staff are suitably qualified to help vulnerable adults.

This report looks at the needs of people with a health condition that affects their cognitive abilities and their capacity to make decisions without support. Based on survey analysis, the report presents evidence that adults with cognitive impairment, such as acquired brain injury, learning disabilities or dementia, are more likely to experience financial abuse and be targeted by fraud. It analyses the current policy debate about the nature of vulnerability in the context of financial services, and makes the case that those with limited or fluctuating capacity should be legally entitled to additional protection or support under the terms of both the Equality Act and Mental Capacity Act. The report also details the increased reliance of people with cognitive impairments on friends, family and carers to help them deal with their finances. It analyses both the ways in which these carers could be helpful and harmful in the fight against fraud. It recommends a number of measures that could better protect at risk people from fraud and financial abuse. (Edited publisher abstract)

Reports on the findings of a three-year research project to investigate incidents of disability hate crime experienced by people with autism and learning disabilities in Medway, Kent. The research was carried out by Autism London, MCCH, Kent Police and the Tizard Centre at the University of Kent. The study included a review of calls to the National Autistic Society and Autism London helplines; focus groups with people with learning disabilities and autism (n=31) and with family and paid carers (n=33); responses to a survey exploring the victimisation experiences of people with learning disabilities and autism (n=255); and in-depth interviews (n=27); and focus groups with the police to identify the difficulties they experience in responding to hate crime. Results found that at least one third of people involved in the research Medway had experienced some form of victimisation as adults. Types of hate crime varied and included physical attacks, threats, verbal abuse and damage to property. Key findings from focus groups with the police identified: lack of a clear definition of disability hate crime, a low level of individual police officers’ knowledge and experience of disability; and lack of a systematic method of establishing whether people reporting victimisation are vulnerable. The report calls for more specialist victim support, counselling and therapies for victims with autism and learning disabilities. It also identifies a need for better and more effective ways for victims to report incidents. Recommendations are made for National and Local implementation. The report also provides some examples of good practice in dealing with situations of victimisation or hate crime. (Edited publisher abstract)
Adults with a learning disability living with elderly carers talk about planning for the future: aspirations and concerns

The majority of adults with a learning disability live with family carers, many of whom are ageing and have support needs of their own. Planning for the future thus becomes the key to preventing a crisis situation when family care is no longer viable because of death or ill health. Existing knowledge and practice are largely based upon the perspective of professionals and carers. This study explores the views, aspirations and concerns of adults with a learning disability, about living at home and planning for the future. Findings show that participants were very aware of the need for alternative housing or support in the future and had clear preferences about their future options. However, they also showed extensive concern for their family carers and this often impacted on their willingness to plan for the future or to move to alternative housing. Their demonstrable awareness of the inevitable death or ill health of family carers, and willingness to engage with the implications, emphasize the importance of involving adults with a learning disability in planning for their future, as well as providing them with bereavement support.
Double jeopardy?: needs and services for older people who have learning disabilities

Increasing numbers of people with learning disabilities are living into older adulthood,creating important challenges for services. Greater local understanding of the specific health needs of this population is crucial to influence needs-led service planning. The study used a questionnaire survey to identify people aged over.. who have learning disabilities,covered by a community health trust in England. Specific types of health problems for this older population were identified,along with the sources and types of community supports received and care staff satisfaction with these supports. The most frequently occurring health problems related to psychological/behavioural,incontinence/excretory and circulatory/respiratory needs. Overall general practitioners,followed by community/district nurses,provided the majority of healthcare support. Generally care staff appeared satisfied with the access and quality of health support. There were alarming findings in relation to some areas of health screening. Cervical,breast and testicular examinations were rare. The implications of the study are discussed.

This paper identifies considerations for managing the risks of abuse during intimate and personal care for people with learning disabilities and complex needs. Drawing on insights gleaned from research involving interviews with staff, policies and procedures in specialist day and residential services, and the development of a staff training resource, the paper identifies a framework for adult protection practice in this critical area of support.
Relative justice: the experiences and views of family members of people with particular needs in contact with the criminal justice and liaison and diversion services

Presents the findings from a consultation designed to inform the development of liaison and diversion services prior to national roll out in 2017. The consultation consisted of four focus groups, involving between 24 and 48 family members and carers of people with particular needs in contact with criminal justice - two focus groups were held in the north of England and two in the south. Liaison and diversion is a process whereby people of all ages with mental health problems, learning disabilities, substance misuse problems or other vulnerabilities are identified and assessed as early as possible as they pass through the criminal justice system. The report discusses the five main themes which emerged in the consultation, including: support for families; meeting families’ needs; awareness of, and contact with, liaison and diversion services; confidentiality; and awareness training. Family members in this study who were in contact with liaison and diversion services spoke highly of the ongoing support both they and their families received. Whether through direct experience, or having heard about liaison and diversion by participating in this study, all family members welcomed the idea that such services could help to facilitate access to information and support. The second year of the Independent Mental Capacity Advocacy Service 2008/2009

The Mental Capacity Act 2005 created the Independent Mental Capacity Advocate (IMCA) service as a safeguard for people without the capacity to make certain important decisions and without family or friends to support them. The Act also introduced a legal duty on NHS bodies and local authorities to refer eligible people to the IMCA service. The service started on 1st April 2007 and this is the report on its second year’s work. There was a 27 percent rise (to 6582) in the number of people receiving representation from the IMCA service compared to the first year. This comprised a 14 percent increase (to 3496) for decisions relating to accommodation moves; a 102 percent increase (to 387) for decisions relating to care reviews; a 43 percent increase (to 968) for decisions relating to serious medical treatment; and a 29 percent increase (to 960) in adult protection proceedings. There is concern that the service is not yet reaching all the people who would benefit, particularly with regard to the continuing low rate of referrals for serious medical treatment. A small study revealed that commissioners were mainly pleased with the service though they wanted IMCAs to be more available and to deliver reports faster. MCA leads in local authorities commented on the professionalism of IMCAs and the benefits to the client group. However, there was a perception within health care settings that involving an IMCA delayed treatment..

One of the 29 recommendations of the 'The same as you?' review was that local authorities and health boards should draw up Partnership in Practice agreements (PiPs). The aim of this national overview report is to provide feedback on the key messages that emerge from a review of all of the 2004-2007 PiPs, taking account of additional evidence from other sources. Key themes identified are: health promotion and improving access to health, Local Area Coordination, carers, short breaks or respite, autism spectrum disorders, Direct Payments, day services, further education and employment, supported living and vulnerable adults. This report aims to highlight positive developments that can be shared to support improvement across Scotland, and to inform the next round of plans for 2007-2010.
