These Regulations implement (in Northern Ireland) the provisions of Council Directive 2000/78/EC (OJ No. L 303, 2.12.2000, p.16), establishing a general framework for equal treatment in employment and occupation ("the Directive"), so far as it relates to disability discrimination but only insofar as the Directive's obligations impact upon Chapter II of Part III of the Special Educational Needs and Disability (Northern Ireland) Order 2005 (S.I. 2005/1117 (N.I. 6)) ("the 2005 Order"). The Disability Discrimination Act 1995 (Amendment) Regulations (Northern Ireland) 2004 (S.R. 2004/55), which came into operation on 1st October 2004, implemented the Directive's obligations with respect to Parts II and III of the Disability Discrimination Act 1995.

The Committee’s key finding in this evidence-led inquiry is that the Mental Capacity Act 2005 is not widely implemented. To address this, the Committee recommends that responsibility for implementing the Act be given to an independent body. The Committee’s second key finding is that the Deprivation of Liberty Safeguards are not fit for purpose. The Committee recommends that they be replaced with new provisions. This report considers: whether the Act is working as intended in respect of the Act’s five core principles; how to address poor implementation of the Act; advocacy and advance planning; whether the Court of Protection is appropriate (or should there be a Mental Capacity Tribunal instead); and criminal law provisions under Section 44 of the Act. It summarises and refers to cases of unlawful detention under the Act (Steven Neary), and the deprivation of liberty of an autistic man with a profound learning disability, HL at Bournewood Hospital for 32 years. It includes as a good practice example, the work by Jim Blair, a learning disability nurse consultant who explained adjustments made for effective treatment and outcomes for adults with learning disabilities appropriate to their needs. The Committee makes recommendations to Government to: work with regulators and professional bodies to ensure the Act is given a higher profile in training, standard setting and inspections; increase staff resources at the Court of Protection to speed up handling of non-controversial cases; and reconsider the provision of non-means tested legal aid to those who lack capacity, especially in cases of deprivation of liberty. Local authorities should use their discretionary powers to appoint Independent Mental Capacity Advocates more widely than is currently the case. The Government should act on the poor levels of awareness and understanding of Lasting Powers of Attorney and advance decisions to refuse treatment among professionals in the health and social care sectors. The Government should also review the criminal law provision for ill-treatment or neglect of a person lacking capacity, to ensure that the Act is fit for purpose. The Committee recommends that the House of Lords seek an update from the Government twelve months from now to find out what they have done in response to their key recommendations. This draft bill aims to deliver on the government manifesto commitments to reform the Mental Health Act; and to improve the way that people with a learning disability and autistic people are treated in law. This draft legislation is intended to give effect to the policy approaches outlined in Sir Simon Wessely's landmark independent review in 2018. These were subsequently taken forward in the government's white paper Reforming the Mental Health Act in 2021. The draft bill contains a number of amendments to the Mental Health Act 1983 (MHA). It follows, more specifically, the Government's 2017 and 2019 Manifesto commitments to reform the MHA so that: 'patients suffering from mental health conditions... have greater control over their treatment and receive the dignity and respect they deserve'; and 'it is easier for people with learning disabilities and autism to be discharged from hospital, with improvements in how they are treated in law'. The draft Bill includes reforms to: strengthen the voice of patients; improve and expand the roles and powers of people who represent detained patients; limit the detention of people with a learning disability and/or autistic people; revise the criteria for the use of Community Treatment Orders (CTOs), and enhancing the professional oversight required for any CTO; remove police stations and prisons as places of safety under the MHA to ensure people experiencing a mental health crisis or with severe mental health needs are supported in an appropriate setting. Work has been underway for some while to regulate domiciliary care services, where personal care is provided, in Wales following powers provided under section 22 of the Care Standards Act 2000. The Minister for Health and Social Services established a Task and Finish Working Group in August 2002 to provide expert advice on the realities of applying Regulations and National Minimum Standards to domiciliary care agencies in Wales.
