Working with independent advocates: good practice guidance for working with independent advocates

In the course of the work of the Mental Welfare Commission, service users and independent advocates have voiced their concerns about involvement of advocacy. They have heard of situations where advocates were excluded from important meetings, or were not given the information they needed to fully advocate on behalf of an individual. The Mental Welfare Commission has also heard from practitioners that they are often uncertain about what involvement the advocate should have, especially if a person has a severe mental illness or learning disability that makes it difficult for him or her to involve an advocate. The authors collected some examples difficult situations and case studies to consult with a variety of practitioner, advocacy and service user groups. They also considered the legal framework, notably mental health and incapacity law in Scotland and data protection legislation. It is hoped that the guidance and case examples will help practitioners to understand the role of independent advocacy and provide assistance when dealing with difficult situations.

This article considers the progress made by the Scottish Executive in reforming the court system to better meet the needs of people with mental vulnerability, in particular through the Vulnerable Witnesses (Scotland) Act 2004.

The Adult (Support and Protection) (Scotland) Act 2007 has made significant changes to the Adults with Incapacity (Scotland) Act 2000 and some drafting improvements to the Mental Health (Care and Treatment) (Scotland) Act 2003. This article outlines the changes. It highlights recognition of advocacy, powers of attorney, changes to intervention orders, guardianship, access to funds and changes to Mental Health (Care and Treatment) Act.
Obtaining views on health care from people with learning disabilities and severe mental health problems

This paper describes a study of methods for enabling people with learning disabilities and complex health needs to comment on the specialist inpatient care they received. Six service users consented to take part in interviews using analogue scales and photographs. The participants were able to engage in all elements of the interviews even though inclusion was more challenging because of additional health problems such as manic depression and paranoid psychosis. The suitability of research tools and approaches are discussed and barriers to inclusion identified. In this investigation a gap emerged between government policy of inclusion for everyone, and the realities of frontline practice where involvement was not achieved for some users with severe/profound disabilities. The study points to implications for increased resources, education and training if meaningful user involvement is to become established for individuals within routine practice.
