An online guide for local authorities providing advice on what they need to do to maintain EHC (education, health and care) plans for 19- to 25-year-olds with special educational needs and disability (SEND). Although young people with SEND are not automatically entitled to maintain their EHC plans after they turn 19, some may need more support to complete their education and training and successfully transition to adulthood. The guide provides advice on how to support 19- to 25-year-olds to meeting their educational and training needs, such as a finding supported internship, access further education; access to funding for those with no EHC plan; supporting a young person’s health and social care; and including young people in decision making. A 2-year national trial begins on 3 April 2018 to extend the power of the special educational needs and disability (SEND) tribunal. The trial gives parents and young people new rights to request recommendations about the health and social care needs and provision specified in Education, Health and Care (EHC) plans, when making a SEND appeal. It also gives the SEND Tribunal new powers to make non-binding recommendations on the health and social care aspects of EHC plans. The national trial aims to create a more holistic, person-centred view of the child or young person’s needs at the Tribunal, bring appeal rights in line with the wider remit of EHC plans, and encourage joint working between education, health and social care commissioners This guidance sets out the extended powers and duties in the Special Educational Needs and Disability (First-tier Tribunal Recommendations Power) Regulations 2017. It explains how the appeal process will work, what happens if recommendations are not followed and the support available for commissioners and families. (Edited publisher abstract)
