Independence or protection – does it have to be a choice? Reflections on the abuse of people with learning disabilities in Cornwall

This commentary uses recent events in Cornwall to highlight the ongoing abuse of adults with learning disabilities in England. It critically explores how two parallel policy agendas - the promotion of choice and independence for adults with learning disabilities and the development of adult protection policies - have failed to connect, thus allowing abuse to continue to flourish. It is argued that the abuse of people with learning disabilities can only be minimized by policies that reflect an understanding that choice and independence must necessarily be mediated by effective adult protection measures. Such protection needs to include not only an appropriate regulatory framework, access to justice and well-qualified staff, but also a more critical and reflective approach to the current orthodoxy that promotes choice and independence as the only acceptable goals for any person with a learning disability.

The White Paper sets out how the Government will provide new opportunities for people with a learning disability, their families and carers. It is underpinned by four key principles: Legal and civil rights, people with learning disabilities have the right to a decent education, to grow up to vote, to marry and have a family, to express opinions, with help and support where necessary; Independence the starting presumption should be independence, rather than dependence, with public services providing the support needed to maximise this. Choice - people with learning disabilities want a real say in where they live, what work they should do and who looks after them; inclusion - enabling people with learning disabilities to do those ordinary things, make use of mainstream services and be fully included in local communities.
Policy implementation in England: developments to meet the mental health needs of people with learning disabilities

This article looks at current initiatives to improve mental health care for people with learning disabilities from around England and places them within a policy context. It highlights the areas that still fail to provide a basic care standard, some of which have been reported throughout the media from recent investigations. Where this is the case, the authors outline the response and actions that have been put in place to address these issues. The article focuses on the areas of 'rights', 'inclusion', 'choice' and 'independence'. They argue that there now needs to be cooperation between services that traditionally have not worked together for the benefit of this client group. The traditional views and values of service provides and commissioners will need to be challenged and tuned to the needs of this group of people.

This article reports an analysis of practitioner and policy implementers' views on implementing the strategy document Valuing People. It is based on empirical data generated from the first phase of a research project that seeks to develop best practice in supporting people with an intellectual disability and dementia. The analysis focuses on how Valuing People's four key principles (choice, independence, rights and inclusion) were drawn on and talked about spontaneously by participants. Each of these four principles has important implications for the provision of services for people with intellectual disabilities and dementia. This article adds to the growing dialogue on service provision for this group.

The Government’s 2005 Green paper on Adult Social Care put forward a vision of ‘independence, well-being and choice’. While the notion of independent living was central to the vision and to the substantive policy proposals presented in the Green Paper, there was no definition of what ‘independent living’ actually means. The British Council of Disabled People (BCDP) supports many of the ideas in the Green Paper, such as the proposed introduction of individualised budgets. It also has concerns about the continuing lack of basic rights to receive support and to live independently in one’s own home, and about the way in which the new vision will be financed and implemented. This article looks at some of the concerns of the BCDP.

In its creation, Valuing People represented a radical departure from the traditional processes of Whitehall policy development. For the first time, people with learning disabilities were actively involved in the working parties from which the White Paper was developed; their views, needs, ambitions, and dreams were reflected in the final document. Subsequent to the White Paper’s publication, the involvement of both service users and family carers has continued to be an important element of the implementation process; in particular they have had an important role to play in Learning Disability Partnership Boards. These new structures within local government aim to bring together key local stakeholders, including people with learning difficulties and family carers as well as social services and health and a wide range of providers of services, in order to raise awareness of learning disability issues beyond the specialist services and plan for the implementation of the changes the White Paper required. Taking as its starting point the assumption that effective implementation of Valuing People would require significant changes to services at both a strategic and operational level, the Strategies for Change project posed a number of questions: How can local strategies be developed which reflect the needs, wishes and concerns of local populations? How can people with learning disabilities and family carers be involved effectively in the work of Partnership Boards? How can the types of support offered to people with learning disabilities be changed, to enable people to take more control over their own lives? What role should commissioners of learning disability services play in bringing about these changes? How have people with learning disabilities experienced previous changes to their support services and how can these changes be user-led?
