Accessing social care and health care services: the rights of adults with a learning disability

This tool kit aims to set out the duties and obligations that local authorities and health authorities have to provide social care and health care services, and to explain how those services can be accessed. It focuses on the law and procedure applicable in Wales, and particular consideration is given to the rights of adults with a learning disability. Part 1 explains how a local authority determines whether a person is eligible to receive services and provides an overview of the key services that are usually available from local authorities. Consideration is also given to when local authorities can charge for the services provided, and how any charges are calculated. Information is also provided regarding carers’ assessments. Part 2 explains the duties and obligations that local health boards have to provide health care services, including community-based services. Consideration is also given to assessing capacity, and when people can be deprived of their liberty. Part 3 explains the key ways in which decisions regarding social and health care can be challenged where there is a disagreement about the level of services to be provided. The tool kit also contains a Future Changes section, which highlights some of the key changes that are likely to occur when the Social Services and Well-being (Wales) Act 2014 takes effect in April 2016. All adults with learning disabilities in Wales are entitled to annual health checks. This article reports on the outcome of a series of focus groups which were conducted with people with learning disabilities to find out their views about health checks. It also contains a table showing how many people in each local health board area of Wales had a health check in 2006/7 and 2007/8.

Health and social care access for adults with learning disabilities across the UK during the COVID-19 pandemic in 2020

Purpose: This paper aims to present data about access to health and social care services during the COVID-19 pandemic for adults with learning disabilities across England, Northern Ireland, Scotland and Wales. Design/methodology/approach: Data were collected directly from 621 adults with learning disabilities and through separate proxy reports by family carers and paid support staff of another 378 adults with learning disabilities. The data were collected between December 2020 and February 2021 and concerned the use of health and social care services since the start of the first COVID-19 national lockdown in March 2020. Findings: Access to and use of health and social care services significantly reduced for adults with learning disabilities across the UK during the COVID-19 pandemic between March 2020 and February 2021, with many people not receiving any services at all during that period. Similar patterns were seen across England, Northern Ireland, Scotland and Wales. However, data suggest some variations between countries for some services. Practical implications: Future pandemic planning must ensure that access to these essential services is not completely lost for adults with learning disabilities and their family carers, as it was in some cases during the COVID-19 pandemic in 2020. Originality/value: This is the largest study about the impact of the COVID-19 pandemic on health and social care services for adults with learning disabilities in the UK. The authors primarily collected data directly from adults with learning disabilities, and worked with partner organisations of people with learning disabilities throughout the study. This toolkit provides information and advice on access and entitlements to health and social care services for people with learning disabilities in Wales. The guide aims to help people are acting as learning disability advocates, including parents, carers, volunteers or professionals by providing them with clear information. The toolkit is divided into three parts: the duties and obligations of local authorities to assess and provide social care and support services; the duties of local health boards to provide health care services, including community-based services and assessing mental capacity; and information about challenging decisions about health and care services. The guide includes links to resources and an additional resources section which provides details of organisations providing information relating to social and health care provision. The All Wales Care Bundle for improving hospital care for people with learning disabilities was launched in January 2014. It sets out key steps at various stages of a patient's stay which if carried out consistently for all patients will reduce vulnerability of their stay in hospital. The author provides an overview. Contact with primary care: the experience of people with intellectual disabilities

Background: People with intellectual disabilities experi-ence disparities in their health and health care. Annual health checks are intended to counter such disparity by improving access to primary health care. However, little is known about their experience of having a health check or other types of contact with primary care services. Materials and Methods: The findings of two studies which used focus groups were combined. 102 people with intellectual disabilities participated in the focus groups. Results: Participants' experiences of primary care services generally, and health checks in particular, were positive. However, unanimity was rare on any of the topics discussed and a number of areas of dissatisfaction emerged. Conclusions: Further studies with larger and more representative samples are necessary as feedback from people with intellectual disabilities about their experience of contact with primary care staff might help to enhance GP knowledge about their health requirements. This article addresses the need for health checks for people with learning disabilities as a proven route to identifying and tackling health inequalities, what health checks should look like (covering physical and mental health) and how they should be followed, and how practices and primary care trusts (PCTs) can implement health checks, involving people with learning disabilities and family carers and drawing on the expertise of community learning disability teams. Experience from Wales and England of offering health checks is described, and some key learning points are drawn out. It is recommended that appointment of a strategic health facilitator to lead to the introduction of health checks and to ensure that the results are used to improve the health and health care of the population of people with learning disabilities.

This article reports on the interim findings of an investigation by the Disability Rights Commission into the health inequalities experienced by people with severe mental illness in England and Wales. The aim of the study was to understand the causes of the inequalities, the extent to which recent initiatives have or have not helped to address the problems, what remains to be done, and how measures can be effectively implemented to prevent unnecessary ill health or death.

This publication uses maps to show the variation in health care for a variety of conditions across England and Wales. The maps are accompanied by commentary on the background context, scale of variation and options for action. Conditions covered include: care of mothers, babies, and children and young people; mental health problems; dementia; care of older people; end of life care; and learning disabilities. Twenty one of the indicators are also presented by local authority area. The Atlas also highlights the work being done by Right to Care to support anyone wanting to reduce unwarranted variation of health care provision within their locality or between their locality and other areas of the country.
