This document is a summary of the responses received during the consultation on revised statutory guidance to implement the Strategy for Adults with Autism in England. It highlights the key themes and common issues from the consultation responses and sets out the Government’s response that has shaped the statutory guidance. Areas that were repeatedly mentioned included the: importance of using more directive and proactive language; value of co-production and consultation with people with autism and carers; need for good initial and refresher training across organisations and sectors; need to allocate dedicated local funding to support service developments; need for health and social services to work together and to work with partners; importance of involving the voluntary sector; need to set up monitoring processes to assess progress; and importance of cross-referencing to other guidance, legislation and resources. The document details the government’s response on: training staff; identification and diagnosis; planning for transitions; local planning and leadership; preventative support and safeguarding; reasonable adjustments; supporting people with complex needs; employment; and working with the criminal justice system. This tool identifies statistical neighbours – or similar areas – for adult social care delivery for older people and working age adults with learning disabilities. These are the two largest groups who receive adult social care. The comparable indicators include spending per head, quality of services and access to services. The tool provides a basis for comparing spending and outcomes between councils and helps directors of adult social services and local authority financial leads to find new opportunities for improving adult social care efficiency. It is for use by councils to assess their own performance, and to identify where different approaches in comparable local authorities may provide examples to learn from. It is not meant to be used to make judgements about the relative performance of councils in delivering adult social care services, nor can it provide answers as to what the ‘correct’ price is for care. This Statement on Policy and Practice provides a vision for the future in which all people with a learning disability are full citizens, equal in status and value to other citizens of the same age. Disabled people have the same rights as other citizens to live healthy, productive and independent lives with appropriate and responsive treatment and support to develop their maximum potential. They also have equal rights to be individuals and decide everyday issues and life-defining matters for themselves joining in all decision-making which affects their lives, with appropriate and responsive advice and support where necessary. The Mental Capacity Act 2005 created the Independent Mental Capacity Advocate (IMCA) service as a safeguard for people without the capacity to make certain important decisions and without family or friends to support them. The Act also introduced a legal duty on NHS bodies and local authorities to refer eligible people to the IMCA service. The service started on 1st April 2007 and this is the report on its second year’s work. There was a 27 percent rise (to 6582) in the number of people receiving representation from the IMCA service compared to the first year. This comprised a 14 percent increase (to 3496) for decisions relating to accommodation moves; a 102 percent increase (to 387) for decisions relating to care reviews; a 43 percent increase (to 968) for decisions relating to serious medical treatment; and a 29 percent increase (to 960) in adult protection proceedings. There is concern that the service is not yet reaching all the people who would benefit, particularly with regard to the continuing low rate of referrals for serious medical treatment. A small study revealed that commissioners were mainly pleased with the service though they wanted IMCAs to be more available and to deliver reports faster. MCA leads in local authorities commented on the professionalism of IMCAs and the benefits to the client group. However, there was a perception within health care settings that involving an IMCA delayed treatment..
