Protection of children from physical maltreatment in Canada: an evaluation of the Supreme Court’s definition of reasonable force

This paper tests the validity of the seven criteria set out by the Supreme Court of Canada in 2004 to distinguish reasonable from abusive corrective force used with children. Reasonable force is administered by a parent, is applied to child of 2-12 years inclusive, does not involve the use of objects or blows to the head, is corrective in intention, and is not degrading, inhuman or harmful. In addition, the child must be capable of learning from it. The criteria are tested against a nationally representative dataset of substantiated cases of physical abuse. The analysis shows that in the majority of cases many of the criteria for reasonable force were met (e.g. 75% were corrective in intention) and that 20% met none of the Court’s criteria for unreasonable force. At the same time some 50% of maltreated children experience spanking as a typical form of discipline. The authors conclude that the criteria are not well founded in reality, and that ending all physical punishment is more likely to reduce physical maltreatment than placing arbitrary limits on its use.

The Prohibition of Female Circumcision Act 1985 makes female genital mutilation (FGM) an offence, except on specific physical and mental health grounds. This Act is being replaced by the Female Genital Mutilation Act 2003, which will be brought into force on 3 March 2004. The purpose of this letter is: (a) to inform the provisions of the new Act and (b) to provide further information in support of the guidelines on female genital mutilation (FGM) in paragraphs 6.52-6.53 of Working Together to Safeguard Children (1999) to enable the improvement of safeguards for children, in light of the new Act.
