Section 11 refers to the Homelessness (Scotland) Act 2003 and is due to be implemented on 1 April 2009. It is part of the commitment that, by 2012, all unintentionally homeless people will be entitled to a permanent home. This guidance is issued under section 47 of the Adult Support and Protection (Scotland) Act 2007 which requires Adult Protection Committees (APCs) and councils to have regard to any guidance issued by Scottish Ministers about their functions under sections 42 to 46 of the Act. This guidance principally relates to Part 1 although the Annex covers other provisions in more detail. Part 1 introduces new measures to identify and protect ‘adults at risk of harm’ which include: placing a duty on Councils to make inquiries and investigations to establish whether or not action is required to stop or prevent harm occurring; a requirement for specified public bodies to co-operate with local councils and each other in investigating suspected or actual harm; the introduction of a range of protection orders including assessment orders, removal orders and banning orders; and a legislative framework for the establishment of local multi-agency Adult Protection Committees (APCs) across Scotland.
