A project to review the law relating to the provision of adult social care in England and Wales. The legislative framework for adult residential care, community care, adult protection and support for carers is inadequate, often incomprehensible and outdated. It remains a confusing patchwork of conflicting statues enacted over a period of 60 years. There is no single, modern statute to which service providers and service users can look to understand whether (and, if so, what kind of) services can or should be provided. The overall aim of the project is to provide a clearer and more cohesive framework for adult social care. This would help to ensure that service users, carers, social care staff, health professionals and lawyers are clear about rights to services and which services are available. It will also aim to modernise the law to ensure that it is no longer based on out-dated principles. The first phase of this project will be a scoping report. This will aim to delineate clearly the scope of the project and provide it with a detailed agenda for reform.

These include consideration the role of statutory principles; community care assessments; eligibility for services; assessment and eligibility for carers; and the provision of services. Part 9 considers local authority adult protection functions. This document analyses the responses received to the Law Commission’s consultation paper, Adult Social Care, published on 24 February 2010. The consultation paper set out 57 provisional proposals and 25 consultation questions on reforming the legal framework for adult social care. The overall aim of the reform is to provide a clearer, modern and more cohesive legal framework for adult social care. Publication of the consultation paper was followed by a 4 month period of public consultation, during which time 72 consultation events across England and Wales were attended and 231 formal responses were received from a wide range of consultees. This document summarises the views received during the consultation period under the following headings: summary; our approach to law reform; statutory principles; community care assessments; carers assessments; eligibility for services; removal of section 21 National Assistance Act and section 2(1) Chronically Sick and Disabled Persons Act; ordinary residence; scope of adults social care; delivery of services; joint working; safeguarding adults at risk; strategic planning; and other issues.
