‘Arm’s length bodies (ALBs) are stand-alone national organisations sponsored by the Department of Health undertaking executive functions. The work they undertake ranges from back office administrative functions to complex ethical or clinical-related work. This report provides details of the reconfiguration of the Department of Health's ALBs announced in October 2003. The key drivers behind this reconfiguration are: devolution of ALB functions to the frontline; appropriate impact for minimal burden to frontline staff; the Gershon Efficiency Review regarding making the public sector more efficient; the Lyons Review of public sector re-location away from London and the South East; and taking an overview of ALBs across the health and social care system. Part 1 outlines a new approach to ALBs. Part 2 sets out a new configuration that reduces the number of ALBs from 38 to 20. Finally, part 3 summarises the approach that will be taken to achieve the configuration. Implementation plans will be required to reduce the cost of the ALB sector by at least £0.5 billion and the number of posts by around 25% by 2007/8. No ALB will be exempt from the need to become more efficient.

Pension reform looks inevitable in the UK. When the Government produced a Green Paper in 2002, despite their intended focus on private pensions, most major organisations said reform of the state pension system was needed. Now the Pensions Commission has confirmed the diagnosis of worsening pension provision, most organisations will be reviewing their pension policy proposals to make submissions to this consultation process. It seems a good time to take stock of the pension reform proposals already on the table, see how far consensus goes, and identify the critical issues left to tackle.

The use of Human Rights Legislation in the Scottish courts (full text)

The research analysed the uses made of human rights legislation in the Scottish courts since devolution. The relevant legislation was the Scotland Act 1998, the Human Rights Act 1998 (HRA), and the European Convention on Human Rights and Fundamental Freedoms 1950 (ECHR). To explore the ways in which the legislation was being used, in terms of arguments based upon the ECHR which had been advanced in supreme and sheriff court cases, this project gathered information about civil and criminal cases between May 1999 and August 2003.
