In recent years, sociological theorising as part of the analysis of modernisation has paid increasing attention to notions of individualism in relation to marriage and domestic relationships. The authors suggest that sociological perspectives fail to recognise sufficiently the importance of children and social actors and the issues that arise from this, such as the rights of children, both in the context of law and family life. Argues that it is time for sociologists and policy-makers alike to give serious consideration to the implications of the issues in the light of recent developments, which make such recognition essential.

There is some confusion around family assistance orders, made available under Section 16 of the 1989 Children Act to provide social work help for families experiencing problems as a result of separation or divorce. The order requires the probation officer or social worker to advise, assist and (where appropriate) befriend those named in the order. This national study surveys family court
