Commissioned as part of a project to help ensure that refugees and migrants receive the protection they are entitled to under UK equality legislation, this briefing is intended to provide clear information about the rights of refugees and migrants in order to help public authorities to meet their needs. It is not intended as a definitive statement of the law. It focuses on responsibilities under the Equality Act 2010, and provides a summary of the main provisions of the Act as they apply to the functions of public authorities (including the public sector equality duty and its 3 aims). The briefing also discusses basic actions which can help public authorities in meeting their equality obligations and advancing equality for all relevant groups, and includes details of sources of further information or advice.

The aim of this briefing is to provide an introduction to the Equality Act 2010 for migrant and refugee community organisations, in order to help them ensure that public authorities and others understand and meet their responsibilities to refugees and migrants under the Act. It is not intended to provide a detailed explanation of the measures in the Act or to constitute legal advice. It explains how the Act applies to refugee and migrant communities, gives illustrative examples of when public authorities could be in breach of the Act, and explains how organisations can use the Act to support service users. It also discusses possible approaches by migrant and refugee community organisations, noting that legal action or challenge should be a last resort. It also includes details of sources of further information or advice.

In late 2009 the Equality and Diversity Forum held two seminars on the impact of the recession and the implications for fairness, equality and social justice. The first seminar ‘Redefining equality and fairness’ discussed the drivers of public attitudes to inequality. The second seminar ‘Visions of the future: policy, economy and inequality’ considered how the debate about fairness triggered by the credit crunch might feed into new policy approaches to the problems of inequality. This report summarises the discussion at the seminars and draws out some of the key issues raised, including: the importance of raising public awareness of the facts about inequality and poverty; whether equality, fairness, social mobility and diversity are the same or different; the current lack of consensus on what fairness means in practice; whether there is a long term global trend to increasing economic inequality; whether social hierarchies and segregation are growing; the importance of ensuring equality legislation achieves its objectives; and the relationship between the benefits system and inequality.
