This paper presents the views of scholars from Australia, Canada, Scotland, France and Sweden on the current working of the Family Justice system in England and Wales. These experts came together at an International Roundtable supported by the Ministry of Justice to discuss the workings of the Family Justice system in England and Wales, and to identify any special features of their own systems that might be of interest in England and Wales. To gain a better understanding of how families experience the family justice system in other countries, vignettes were prepared based on the most common issues which come before the family courts: making arrangements for children and finance on separation and divorce; and child protection work. The experts describe how a family coping with such a matter would be dealt with in their own jurisdiction. This paper summarises the information collected and discussed at the Roundtable meeting, and then reviews issues arising for England and Wales. It reveals both familiar problems and key differences in approach, but also the high regard in which other countries hold the child centredness of the approach used in England and Wales.

Discusses how debates over the child protection system in the UK have been enlivened by comparative analysis of continental procedure. In particular, enthusiastic claims have been made about the approaches adopted in both France and Belgium. Both systems, so it is claimed, avoid the legalism and the punitive attitudes of the English and Welsh system, thus making child protection more effective for children and families and less antagonistic and demoralising for child care professionals. Describes a comparative pilot study of the role of judicial decision making in France, in the Flemish Community in Belgium, and in England.
