Trafficking in human beings has become a major problem in the UK. An increasing number of people, the vast majority of them women and children from impoverished parts of the world are falling victim to trafficking for the purposes of sexual or other exploitation. These victims regularly find themselves in a perilously vulnerable situation, often facing coercion and violence, unprotected by employment law safeguards and fearful of attempting to get help from the relevant authorities. This book sets out the legal framework and practice at national level with regard to human trafficking, including the changes brought about as a result of the UK ratification of the Council of Europe Convention on Action against Trafficking in Human Beings in 2009. The author begins by explaining and discussing issues of theory such as definitions of legal terminology but goes further by providing practical guidance on how to assist victims. Covering both the use of civil law and criminal law, it offers advice on how to deal with the identification of victims and how best to use national referral systems. The book is aimed not only at practitioners, advisers and policy-makers working directly with victims of trafficking but also the non-specialist practitioners who encounter trafficked persons and would like to know how to help them.

Since the publication of the first edition of Discrimination Law Handbook there have been major changes to anti-discrimination law, with new definitions and new rights against discrimination on grounds of sexual orientation, religion or belief and age. The scope of the Disability Discrimination Act has been increased and public authorities have new positive duties to promote disability equality and gender equality. There is far greater protection from discrimination both in employment and in other areas of people's lives, but never has it been more difficult to understand and advise on the law, scattered as it is in a variety of Acts, regulations, Codes of Practice and Directives. Written by a team of discrimination and law experts, Discrimination Law Handbook navigates this complex route map. It is the only fully comprehensive, up-to-date guide to anti-discrimination laws. It provides an unrivalled blend of authoritative guidance, detailed explanation of UK and EU law and practical, accessible advice.

Age discrimination is the most widespread form of discrimination in the workplace. It can be overt and deliberate, or it can be subtle and unintentional. It can take the form of individual decisions made by employers or colleagues, or be embedded into the policies and systems of an organisation. Importantly, age discrimination can affect people of any age. The Employment Equality (Age) Regulations in force from October 2006 implement the EU Framework Directive on Equal Treatment in Employment and Occupation and make discrimination on the grounds of age unlawful in employment and education. Employers are no longer permitted to use age as a criterion for recruitment, promotion, training and termination, and significant changes have come into force that affect retirement, pay and benefits and pension schemes. The Handbook is a comprehensive, yet practical, guide to the new law. There is expert guidance on the regulations with extensive cross-references to other strands of anti-discrimination law. Particular attention is given to the various loopholes, justifications and exceptions that are specific to this type of discrimination law and will present challenges even to the most experienced adviser.

The Human Rights Act 1998 imposes radical changes on UK law and practice: all statutes have to be reinterpreted to "read in" human rights, all public authorities (including the courts) have to comply with the European Convention on Human Rights, there is a new right of action against those who fail to do so, and breach of a Convention right is a defence in criminal and civil proceedings. The Act incorporates into UK law not only the Convention itself, but also the extensive case-law of the European Court and Commission of Human Rights. Presenting a detailed analysis of the Human Rights Act 1998 and the case law of the European Court and Commission of Human Rights, this book draws on all 1500 cases (reported and unreported) from Strasbourg which affect UK civil and criminal law. They are set out in a way designed to enable practitioners and advisers to concentrate on those cases most relevant to their area of practice.
