Winterbourne – questions should be asked at the highest level

This article summarises the findings from the serious case review related to Winterbourne View Hospital. Castlebeck Ltd, the owner of Winterbourne View Hospital, took the financial rewards without any accountability. It placed adults with learning disabilities and autism under the supervision of poorly paid and untrained staff. It did not challenge the frequency with which physical restraint were deployed. It also failed to act on the complaints and concerns of patients, relatives or of visiting professionals. The article concludes that although the sentencing of staff will bring the criminal justice process to a legal conclusion, this will not address the more urgent issue of corporate responsibility at the highest level.
Deprived of liberty - a life within padded walls

In this article, a consultant in care and health law presents and discusses a legal case involving a severely autistic man and his treatment at a residential school run by the charity Scope under a contract with Wigan Borough Council. The article describes the background to the case and explains that the man, who exhibited challenging behaviours, was frequently secluded in a padded room, both as a child and as an adult. It looks at his status under the Mental Health Act and the arguments made in the court case (C v A Local Authority and Others). It reports that the Court concluded that the man's general living arrangements amounted to a deprivation of liberty which needed prior legal authorisation, and a breach of certain human rights. The author highlights key lessons from the case regarding assessment, seclusion, deprivation of liberty, and best interests and least restrictive options.
