This guide provides a summary of the current Government guidance on visiting inside care homes in England and the relevant legal duties on care providers. It provides an overview of the legal duties on care providers relevant to visiting, including the Care Act, Mental Capacity Act and Human Rights Act. Aiming to be practical, accessible and user-friendly, the guide also contains worked examples and pointer questions. The guide is not legal advice, but we hope it will help care homes to explore their visiting policies and practice, to help respect and protect the rights of residents. (Edited publisher abstract)

This report is based on a survey of inspection reports from 100 care homes, up to the end of February 2009. These inspections were carried out by the Commission for Social Care Inspection and all homes included were among those rated as providing 'adequate' care, being awarded only 1 star. The homes featuring in this survey were anonymised. The aim of this report was to reflect on the successes and deficiencies of inspection within social care to date and to draw lessons for future models of inspection, thinking in particular of the newly established Care Quality Commission.
