This practical guide, commissioned by the Department of Health, outlines the legal basis for the safeguarding of vulnerable adults at risk of harm in England. It aims to equip practitioners with information about how to assist and safeguard people and explains the law in reasonably simple terms. Although aimed primarily at practitioners it may also be useful for volunteers and family members. As an introduction 21 case studies are included with guidance on how they should be handled. Part B provides an outline of the legal framework in the following sections: the government’s No secrets guidance; the key human rights of protection, justice, empowerment; and legal action and complaints under the Mental Capacity Act 2005. The areas of: whistle blowing, regulation of providers and the workforce, financial abuse and property harm, physical and psychological harm, sexual harm, and protective orders, injunctions and other interventions are also covered. [Note: The information contained in this report is now out of date. The Care Act 2014 now sets out the legal framework for how local authorities and their partners should work to safeguard adults with care and support needs from abuse or neglect.
