Abstract:

This article explores implications of section 20 of the Children Act 1989 on private fostering. It explains how in cases where accommodation is provided for children under the age of 20, the child is regarded as looked after, whereas if accommodation is provided under the age of 17 the child is considered a child in need. The article explores the differences between these two categories in terms of responsibilities of the local authority. In ending, the article examines specific judgements made in a number of cases.
