Abstract:

Commissioned by the Welsh Assembly Government, this report looks at the benefits and risks involved in devolving youth justice to the Welsh Assembly Government. It focuses on the prevention of youth offending and the administration of justice. It discusses; the current interface between devolved and non-devolved functions as they relate to youth justice and youth crime prevention, assessment of the barriers and interface between devolved and non-devolved youth justice functions, likely benefits and risks for tackling youth offending that might be associated with devolution of responsibility for youth justice, accommodation for and the views of Welsh children and young people in penal custody, financial implications, and benefits to Welsh children and young people if the system was devolved. The author concludes that devolution would not eliminate the dilemmas and conflicts inherent in youth justice but that "the politics would become more nuanced because they would be better informed by the local experience and needs of local people".
