Abstract:

The UK sex offender register, started in 1997, is used for monitoring and supervising those living in the community who have been convicted of sexual offences, and included 'lifetime' registration provisions. In the case F and Thompson v. Home Office 2010, the UK Supreme Court declared that the absence of a right of appeal against registration for those who are assessed as no longer at risk of offending made the sex offender registration law incompatible with the European Convention on Human Rights. This article considers the judgement and the mechanisms for deregistering sex offenders that have now been proposed. It covers the background, the position in other countries, the Council of Europe, the legal challenge, and the response in Scotland, England, Wales and Northern Ireland.
