Abstract:

This document provides best practice guidance based on the findings of inter agency workshops. It sets out examples and puts forward suggestions as to how colleagues can best work together, understand each other's roles and put the child at the centre for care proceedings. The guide is in two sections. Chapter 2 covers the pre-proceedings states up to the point that a s.31 Children Act 1989 application is issued at court. This section includes the letter before proceedings, the pre-proceedings meeting, public funding of legal help and legal aid, assessments, safeguarding and child protection, and working with partner  agencies. Chapter 3 looks at the stages from the point that the local authority issue a s.31 Children Act 1989 application through to the conclusion of the proceedings. This section includes preparing an application for court, advocates' meetings, care planning, the role of the Children's Guardian and the Independent Reviewing Officer, and collective participation and cooperation.
