Abstract: |
Focusing on the youth justice system from a custody perspective, this paper presents the recent history of the juvenile secure estate (comprising secure children's homes, secure training centres, and young offender institutions) and youth justice in England and Wales. It argues that the present system is too large, complex and costly, and that most institutional regimes are unresponsive to the needs of children and fail to achieve their rehabilitative objectives. It discusses secure and custodial provision for children and young people from 10 to 17 years old, diversion of young people from custody, prospects for change and government policy, and the deaths of children in custody. The authors contend that the government should, as a matter of urgency, establish a joint review of youth custody by the Ministry of Justice and the Department for Education, and make recommendations about the focus of such a review. The article includes tables showing the characteristics of juvenile secure estate facilities, changes in secure provision from 1990 to 2010, and the use of secure children's homes 2000 to 2010. |
